Commercial insurance policy disputes
In the second part of our new Case Study series, in which we publish real-life examples of cases Gaby Hardwicke has handled, we turn to the subject of commercial insurance policies.
In this case our client’s insurer sought to avoid paying out after a fire wreaked damage in excess of £5 million to our client’s premises and the surrounding properties. The insurer tried to refuse cover, citing an onerous policy endorsement that our client had failed to fulfil but which had not been fully brought to its attention. After dealing initially with the insurer’s loss adjuster, into the fray came the insurer’s solicitors, a well-known City firm.
