Divorce financial proceedings to become separate

A change to the way financial proceedings in divorce cases are administered should lead to a smoother, faster resolution for clients. From 19 June 2017, financial proceedings will be ‘administratively de-linked’ from divorce proceedings in courts across England and Wales.

Since 2015, divorce and dissolution proceedings have been dealt with via specialist divorce centres. Currently, when a contested financial application is made, all proceedings related to the divorce are transferred to a local court. This, unfortunately, leads to delays as the files are transferred between courts.

The new system, which was piloted successfully in the south-west region, will see the creation of a separate financial remedy file. This will be dealt with through a separate process, while the main divorce proceedings remain at a specialist divorce centre. It is thought the change could cut delays by up to two weeks.
