Disputes involving Wills, Inheritance, LPAs and Deputyships
We are experienced in advising clients on challenging or defending a Will where there may be grounds for the Will to be set aside. This could be, for example, where it is disputed whether the person making the Will had the necessary level of mental capacity when the Will was signed, or where they were allegedly subjected to undue influence by someone else. It may even be that the Will is suspected to have been forged.
It is also possible to challenge the terms of a Will if someone who was financially dependent on the deceased has not been reasonably provided for, and again we are experienced in both challenging and defending Wills in these circumstances.
We are also experienced in representing clients in proceedings in the Court of Protection relating to the appointment and conduct of Attorneys under a Lasting Power of Attorney or of Deputies under a Deputyship Order.
In all the above cases, time is of the essence and if you do not act quickly you may find that your position has been seriously weakened, or even that you are out of time for taking any action.
