Joshua Fairweather

Associate Solicitor, Private Client and Inheritance Disputes

Josh qualified as a solicitor in 2020 having gained five years’ experience in Private Client before that, mainly specialising in Probate, before commencing his solicitor training contract.

He graduated from the University of Kent in 2012 with a first class honours degree in law and was awarded the faculty prize for outstanding results. He undertook the Legal Practice Course part-time from 2016 to 2018 and achieved a distinction, with particularly strong performances in the Private Client and Litigation modules.

Josh now practices in all areas of Private Client including Wills, Powers of Attorney, Probate and Estate Administration, Declarations of Trust and general Estate Planning. He is an affiliate member of the Society of Trust and Estate Practitioners.

Josh additionally specialises in Probate and Trust Disputes, including claims under the Inheritance (Provision for Family and Dependants) Act 1975, disputes over Wills including claims for lack of capacity, undue influence and due execution, applications to remove executors and trustees, and claims arising in the Court of Protection over contested Deputyship proceedings, Attorney disputes and Statutory Wills.

Josh’s dual-expertise in both contentious and non-contentious Private Client work also means he is perfectly placed to advise executors and trustees on the defensive and protective steps they can take and the strategies they can employ when facing disputes with beneficiaries or claims against the estate/trust.

Outside work he is an avid musician and has fronted a local rock ‘n’ roll band as the lead singer and guitarist. He also enjoys reading, the occasional game of tennis and long walks in the country.
