A question that can arise in children disputes where the Family Court decides that one parent should spend time on a supervised basis with their child/ren at a contact centre, is who should be responsible for payment of the contact centre’s costs.
In a recent High Court decision the Judge determined that it was possible to order a parent to contribute towards the costs of contact.
The Judge also considered whether such an Order should be made against a resident parent who was found to be the victim of domestic abuse concluding that it would be exceptional to require a proven victim of domestic abuse to pay towards their abuser’s contact.
In addition, he gave guidance setting out the relevant factors to be considered in determining this point.
This is an important decision as there is little case law that exists in relation to payment of contact centre fees.
